DEPORTATION / REMOVAL DEFENSE

By The Shulman Law Group (30+ days ago)

Sometimes, individuals or family members who are in the United States, legally or as undocumented aliens, are placed in deportation or removal proceedings. There are three agencies, which may have jurisdiction or input into a deportation hearing or removal proceeding:

USCIS – U.S. Citizenship and Immigration Services (for green cards and citizenship)
ICE – U.S. Immigration and Customs Enforcement (for deportations and investigations)
CBP – U.S. Customs and Border Protection (for airport and border crossing issues)
The procedures for determining whether an alien is to be removed from the United States are set forth in the Immigration and Nationality Act (“INA”) and corresponding regulations. The procedure used in a given case depends on the individual’s circumstances.

Some individuals are not entitled to a hearing before an immigration judge and may be ordered removed by an immigration enforcement officer. Most aliens, however, are entitled to an on-the-record hearing before an immigration judge, who is authorized to grant applications for relief and protection from removal.

HOW CAN THE SHULMAN LAW GROUP HELP YOU?
An immigration attorney is instrumental in deportation/removal defense cases. At The Shulman Law Group, our attorneys will present your case before the Executive Office of Immigration Review (EOIR) in order to prevent the deportation or removal of the alien. Our immigration attorneys help you determine what forms of relief or protection you may have, prepare the alien for the hearing, and represent you before the Immigration Judge.

If you need a visa, wish to immigrate, or want to help bring a family member or employee to the United States, we can help. If you are facing deportation or removal for any reason, you need our help. Contact our office, located in Paterson, NJ, for more information or to schedule an appointment.
